Terms of Service

Thank you for using CloudMade's Downloads Service. By using the Downloads Service you agree to these Terms of Service as well as the CloudMade Terms and Conditions (http://www.cloudmade.com/terms_conditions).

Cloud Made Ltd ("CloudMade") reserves the right to update and change from time to time, these terms and other documents referenced, without notifying you. The latest Terms of Service will be available from http://downloads.cloudmade.com/terms_and_conditions.

  1. Uses and Restrictions
    1. The CloudMade Downloads Service ("the Service") provides you with access to computer files containing map data. The files are made from map data based on data from the OpenStreetMap.org project ("the map data"). All of the map data accessed using the Service is licensed under the terms of the Creative Commons Attribution 2.0 License (Cc-by-SA 2.0) You can find out more about the CC-by-SA 2.0 license here. BEFORE USING THIS SERVICE YOU SHOULD READ THE CREATIVE COMMONS ATTRIBUTION 2.0 LICENSE and understand how it applies to you.
    2. Any application that uses the Service must (i) include appropriate attribution to the contributors to the OpenStreetMap project as required by the terms of the CC-by-SA 2.0 license. Failure to comply with either of these terms will result in the immediate and automatic termination of this license.
    3. Subject to the restrictions set out in these Terms of Use YOU MAY use the Service. This License may be terminated at any time by either party. The Terms of Use will terminate automatically if you violate any of these terms OR those of the CC-by-SA 2.0 License.
    4. CloudMade reserves the right at any time to change the Service and to at any time release new versions of the Service and require you to use the new versions.
    5. By way of example and not by limitation you agree that you will not:
      1. use the Service in connection with or to promote any products, services, or materials that constitute, promote or are used primarily for the purpose of dealing in: spyware, adware, or other malicious programs or code, counterfeit goods, hate materials (e.g. Nazi memorabilia), goods made from protected animal/plant species, recalled goods, hacking/surveillance/interception/descrambling equipment, cigarettes, illegal drugs and paraphernalia, pornography, prostitution, body parts and bodily fluids, stolen products and items used for theft, fireworks, explosives, and hazardous materials, government IDs, police items, unlicensed trade or dealing in stocks and securities, gambling items, professional services regulated by state licensing regimes, non-transferable items such as airline tickets or event tickets, non-packaged food items, weapons and accessories;
      2. use the Service in a manner that exceeds request volumes that are set by CloudMade and published to CloudMade's website (http://www.cloudmade.com);
      3. use the Service to operate any mission critical application or facility where human life or property may be put at risk.
  2. Charges, Payments and Advertising
    1. CloudMade reserves the right at any time in the future to charge for the use of the Service.
    2. CloudMade reserves the right at any time in the future to include advertising on or associated with the Service at CloudMade's soul discretion.
  3. DISCLAIMER OF ANY WARRANTY
    1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW CLOUDMADE EXCLUDES ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS RELATING TO THE SERVICE AND THE USE OF THE SERVICE (INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES IMPLIED BY LAW OF SATISFACTORY QUALITY, FITNESS FOR PURPOSE AND/OR THE USE OF REASONABLE CARE AND SKILL).
    2. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. CLOUDMADE SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE YAHOO! MAPS APIS, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE), OR ANY OTHER PECUNIARY LOSS, WHETHER OR NOT YAHOO! HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES SHALL YAHOO! BE LIABLE TO YOU FOR ANY AMOUNT.
    3. CLOUDMADE MAKE NO WARRANTY THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED SECURE OR ERROR-FREE.
    4. CLOUDMADE WILL NOT BE RESPONSIBLE FOR ANY DAMAGE CAUSED TO COMPUTER SYSTEMS OR ANY LOSS OR CORRUPTION OF DATA CAUSED BY OR IN CONJUNCTION WITH THE USE OF THE SERVICE.
